Buyer : (referred to also as “Buyers”, “Recipient”, “Recipients” or “Receiver”) means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service to buy a file (“Product”) or receive a link to buy a file (“Product”).

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions . These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service and  you should leave the Website immediately .

Filepay.me reserves the right to update and change the Terms of Service at their discretion without notice. Any new features in excess to the current Service shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. By using Dropbox to login into Service or to select your file you agree to Dropbox's Terms of service.

By using Google drive to login into Service or to select your file you agree to Google Drive's Terms of service.

By using PayPal to handle payments you also agree to PayPal's Terms of service

Payment

Filepay.me uses the PayPal platform and API as payment processing provider .

By using the Filepay.me Service you also accept and are bound by Paypal's Terms of Service.

You understand that in order to use the Filepay.me service you must have an active Paypal account and be bound by the Paypal terms of use 

You expressly understand  and agree that Filepay.me shall not be held liable for any payments and monetary transactions that occur when You use the Service and that all payments and transactions are handled by PayPal. You agree to not hold Filepay.me  liable for any loss or damage issues regarding financial and monetary transactions between You and any other party, including PayPal.

You are solely responsible for all transactions  processed when using Filepay.me and/or Paypal. Filepay.me will not be liable for any losses or damages arising from invalid or fraudulent transactions through usage of the Service or connected Paypal accounts. This includes but is not limited to transactions that were not processed due to a network communication issue. If you process a transaction it is Your responsibility to ensure that the transaction was successfully processed .

You acknowledge  that you are subject to Paypal fees for all transactions when using Filepay.me and Your Paypal account.

Selling and Buying Files

Filepay.me uses the Dropbox and Google Drive platforms to select User's files

By using the Filepay.me Service you also accept and are bound by Dropbox's Terms of service and Google Drive's Terms of service.

You understand that in order to use the Filepay.me service you must have an active Dropbox or Google Drive account.

You understand that Fielepay.me does not host your file or upload it in a server.

You  expressly understand as a Seller, that when You select a file from Your Dropbox or Google Drive account to sell it, You are responsible for the quality of Your files and You should keep the selected file in your Dropbox or Google Drive account until the file is downloaded.

You understand as a Buyer, that you can not download a file until a payment has been successfully processed by PayPal.

Filepay.me do not take responsibility for the provided files by the Seller. You understand as Buyer that you should inform yourself about the Seller before making any purchase.

Pricing

You are solely responsible for the price of your file. We do not take responsibility for Incorrect pricing or wrongful purchase. If You, as Buyer notice that the price is not correct, it is Your responsibility to contact the sender to send you a new link with a correct price. 

We do not take responsibility and have no liability to compensate You for any transaction or refund.

Customer service 

You as a Seller are solely responsible for all customer services with your Buyer's issues including but not limited to pricing, cancellations, refunds, warranty, technical support. You will always present Yourself as a separate entity from Filepay.me.

We encourage buyers to work with sellers before opening a complaint or asking for refund. 

Taxes

You are solely responsible  to include any taxes that apply to your sales to the final price of your link. You are also solely responsible to collect, report and remit the correct tax to the appropriate tax authority. 

General conditions

The Website and Service is intended only for persons who are 18 years old or older. By accessing or using the Website or Service, you represent and warrant that you are legally capable of entering into binding contracts and are at least 18 years old. 

Your use of the Service is at your own risk. The service is provided on an "as is" and "as available" basis.

You acknowledge and understand that Filepay.me uses third party vendors to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.

You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Filepay.me, or any other Filepay.me service.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service.

We may remove Content and Accounts containing Content that we determine in our sole discretion are violating the Terms of Service, including but not limited to content deemed unlawful, offensive, threatening, libelous, defamatory, pornographic, explicitly obscene, generally objectionable or violating any party's intellectual property.

Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Filepay.me employee, member, or officer will result in immediate account termination and potential criminal charges.

You must not upload, post, host or transmit any worms, viruses or any other code of a destructive and furtive nature.

You must not upload, post, host, or transmit unsolicited email, SMSs, or "spam" messages.

Refunds

Filepay.me does not take part in the refund process. PayPal facilitates all payments. If there was any problem in the purchasing process and you insist on a refund please inform yourself about the possibilities provided by PayPal here:

Accountability

We have no responsibility or liability for providing  any additional fees caused from chargebacks or fraudulent transactions.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

User Content and Your Conduct

The Site may include interactive areas or services (“Interactive Areas”) in which you or other users create, post or share content, messages, product information, materials, data, information, text, music, sound, photos, video, graphics, applications, code or other items or materials ("User Content"). You are solely responsible for your use of such Interactive Areas and the User Content you post.

Create an account. post any content or purchase any file / product if you are not over 18 years of age;

Modify, adapt, hack or emulate the Site or the Site Materials;

Circumvent or attempt to circumvent any filtering, security measures or other features designed to protect the Site, users of the Site or third parties; and

Infringe upon or violate the rights of Filepay.me, its users or any third party.

Filepay.me takes no responsibility and assumes no liability for any user conduct or for any User Content posted, stored or uploaded on the Site, nor is Filepay.me liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. Your use of Interactive Areas and the Site is at your own risk. Enforcement of the user content and conduct rules set forth in the Site Terms is solely at Filepay.me's discretion, and failure to enforce such rules in some instances does not constitute a waiver of our right to enforce such rules in other instances. In addition, these rules do not create any private right of action on the part of any third party or any reasonable expectation that the Site will not contain any content that is prohibited by such rules.

Although Filepay.me does not control and has no obligation to screen, edit or monitor any of the User Content posted in any Interactive Area, Filepay.me reserves the right, and has absolute discretion, to remove, screen or edit any User Content posted or stored on the Site at any time and for any reason without notice, and you are solely responsible for creating backup copies of and replacing any User Content you post or store on the Site at your sole cost and expense. You understand and agree that the use of your or other users name, likeness, voice or identity in connection with such User Content or other features of the Site does not imply any endorsement of the Site or of Filepay.me unless explicitly stated otherwise. You represent and warrant that: (i) you own and control all of the rights to the User Content that you post or you otherwise have the right to post such User Content to the Site and grant the rights granted in the Site Terms; (ii) the User Content is accurate and not misleading; and (iii) use and posting of the User Content you supply does not violate the Site Terms and will not violate any rights of or cause injury to any person or entity.

Filepay.me may provide third party content on the Site and may provide links to Web pages and content of third parties (collectively the "Third Party Content") as a service to those interested in this information. Filepay.me does not control, endorse or adopt any Third Party Content and makes no representation or warranties of any kind regarding the Third Party Content, including without limitation regarding its accuracy or completeness. You acknowledge and agree that Filepay.me is not responsible or liable in any manner for any Third Party Content and undertakes no responsibility to update or review any Third Party Content. Users use such Third Party Content contained therein at their own risk.

Feedback & Submissions

You acknowledge and agree that any feedback, information or materials you submit to Filepay.me regarding Filepay.me, the Site, or Filepay.me's products or services, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, or creative materials, whether provided by you in the form of email or other submissions to Filepay.me, or any postings on the Site (collectively the "Submissions"), are non-confidential and will become the sole property of Filepay.me. Filepay.me will own, and you hereby assign to Filepay.me, all rights in and to such Submissions, including all intellectual property rights, and Filepay.me will be entitled to the unrestricted use and dissemination of such Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Indemnification

Filepay.me shall not be liable to you or to any third party for outages, downtime, connection issues, or unavailability of files or data stored on any server.

Filepay.me does not warrant that (I) the service will meet your specific requirements, (II) the service will be uninterrupted, timely, secure, or error-free, (III) the results that may be obtained from the use of the service will be accurate or reliable, (IV) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (V) any errors in the Service will be corrected.

You expressly understand and agree that Filepay.me shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Filepay.me has been advised of the possibility of such damages), resulting from: (I) the use or the inability to use the service; (II) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (III) unauthorized access to or alteration of your transmissions or data; (IV) statements or conduct of any third party on the service; (V) or any other matter relating to the service.

The failure of Filepay.me to aggressively enforce any right or provision of the Terms of Service shall not be construed as a waiver of such right or provision. The Terms of Service outlines the entire agreement between you and Filepay.me and supersedes any prior agreements between you and Filepay.me including prior iterations of the Terms of Service.

The Terms and Conditions shall be governed by the Algerian law.

Termination

We have the right, without notice and in our sole discretion, to terminate your license to use the Site, and to block or prevent your future access to and use of the Site.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service.

You agree that the original English text shall prevail in the case of a dispute.
